I don't think this type of contract has ever been enforceable, as it restricts your ability to earn a living, and no doubt the EU Human Rights act has something to say on the matter.
Dual trading though is a different matter. If you go on a Hillarys lead and sell non-Hillarys blinds, you've probably got breach of contract with Hillarys, and some form of mis-representation with the customer. We had a local guy some years ago selling blinds and telling customers they were Hillarys, mainly to little old ladies.
If anyone wants to set up independent of Hillarys, I wish you well, but anyone trying to rip off and deceive customers frankly deserves whatever Hillarys or the customers throw at them

dibsdobs, Fair point. What I was really getting at is this guy used to sell absolute cr@p to old dears, telling them it was Hillarys in the days when we had really good product. I've seen some of the pleated he sold - 35mm venetian top and bottom rails, with what looked like blotting paper in between One woman said she was going to complain, and he was pretty arsey with her. Took her blind away, recorded it and shoved it back through her letter box, leaving an 80 year old woman to refit her own blind. Funnily enough, he was finally caught out on a wooden venetian. He was selling real rubbish, not much cheaper than Hillarys when we had really good woods

I have started this new thread to highlight the everyday problems we, the advisor's are facing with our diaries all the time. My intention is to highlight the problems we are all facing each day and the demoralizing effect it is having on the sales force. One of the major problems facing each and every one of us. IF WE ALL STAY SILENT THEN IT WILL NEVER IMPROVE.Please post your problem as clear as possible by clicking on reply above this posting box. Do not deviate with personal remarks. Try to be concise. This address was obviously wrong, as it was in a different part of the country...but I had one last week that was just the wrong street in the right town.... so I put it down as customer not in, and then had to go back the following week to the right address and apologise....... I asked for £20 error payment, but have so far not had a reply

Trouble is, I was Kind of whishing that some of the non postors would get involved so as to give it more clout but as usual they just log in, read the posts and log out again. I know this is a major problem for all the advisors but so long as it is just a few that post on the subject then Hillarys will think it is just a few, although I do suspect they know it is a lot more. Then why don't we have a Bi-monthly poll on here on specific subjects as we did about the 'claw-backs' some time ago?
What was the final result of that by-the-way?
With these polls you could email all members about the subject first & then they can log on & answer the question without having to post!!!!
It would be a good compromise!!!!
We could for example have a poll on Verticals & how people feel about the quality.
Or whether they feel the 129 for £3 promotion is any good?!!!!
Or we could ask how many members think Management are arse-holes?!!!!

One incorrect number when ringing enroute. Luckily they were in. Another appt told we do remote control roof blinds. In and out in 5 minutes even after quoting sale prices.(6 slots yeah right) Next appt wanted 4 for £129 havent received Trinity samples. Lovely old couple let them have Clouds instead. Cant be doing with a second sales visit for that amount.

I asked for £20 error payment, but have so far not had a reply That is one reason why if the customer appears to be out, I always call the customer from the door. If it is the right house, you can often hear the 'phone ringing. Then if no answer, you know customer is out and you have the correct address. If customer answers, you can verify the address, sometimes they have not heard the door, and may very well be in. The cost of a call is better than the return visit.

Its better than having a family row which has happened in the past.and I am not that quiet, but then I do have a really good FSM that has been trying to help me. We could do it as a poll on the forum but might again get a limited response due to apathy OR we could actually put together a questionnaire which each member has to complete as part of any re-registration process if/when we tighten up the security of the site. We could ask them all to tell us things like : - how frequently do you log on - have you ever posted to the forum - what is your reason for not posting - do you feel that the forum fulfills a useful purpose - etc, etc Any ideas - what are the best ten questions that we can ask that will help us to guage the feelings of the silent majority and then take measures to overcome any obstacles and entice more people to become more active ?

Hereticus, I had thought about a poll the same as you but then what would we do with the information? If its apathy that stops postings then the ball is in Hillary's court over that one. If its because its too negative then the members themselves need to make it more positive which probably brings us back to point one and apathy. If its because they dont know how then they only need go to help at the top of any page. If its because they are scared of reprisals then that again is down to the culture that Hillary's have fostered and again the ball is in their court. Or maybe its just because they have nothing to say. I do agree a poll with ten answers would give better insight but what to do with the results is another matter. We could discuss this a little more tomorrow if you like after the main meeting. Theres a nice little pub just round the corner that does an excellent carvery so if you and Motters are up for it then im am ok. I dont mind leaving Nottingham till after 6 to avoid rush hour.
