I agree, you should be able to take time off when you want, after all that has to be one of the main advantages to being self employed. Our FSM has always asked to let them know when we are planning holidays so that they can cordinate cover for the area. We must be the only agent in this area that ever takes a holiday as we have yet to be told of another agents' holiday!

We have had so few leads, and so little commission lately, that Mick (hubby/fitter) is doing some roofing work for a friends building company. (Mick is a fireman - likes ladders and roofs!). This is why I have not been able to give my FSM much notice to take 3 weeks off. The trouble is - the pay for roofing is better than Hillarys. Just leaves me to find other work..... Or maybe I'll retire. ;D

Self employed guide lines clearly state that you work the hours and times of your choosing.
Did you also know that if our self employed status is eroded away, and in the eyes of the law we become "employed", Sillary's would be liable for our previous tax, as they would have been deemed as paying us our commission after tax was deducted at source. (We would be able to claim back any tax that we had paid).
And it goes on to state that Sillarys would have no right to try and reclaim any tax that they had paid back from us.
lt is up to Sillarys ( as the employer) to deem our employment status and not us. So if they keep pushing forced availability and the purchase of Sam etc they could end up on very dodgy ground.
Not only is there UK law, but there is European law.

GB,
Sillyards are close to illegal on many levels these days.
With the amount of complaints that the Trading Standards people are getting nationwide I think it is only a matter of time before they are investigated.
The reason they may have not been investigated so far is that most Trading Standards offices don't co-ordinate complaints nationally.
It may take a programme like BBC Watchdog to bring this to their attention.
The problem is that they only react to 'Customer' complaints rather than disgruntled Agents!!!

Didn't someone on here fit blinds for Nicky Campbells wife/girlfriend in the flat they share? ( He is the presenter of Watchdog) Cant remember who.... ? Any chance of a backdoor entry here? A bit underhand perhaps, but when you deal with Hillarys whats wrong with playing by their rules? Whatever did happen to STOLEN COMMISSION?? Bear

I see Ross Kenny checked in here on this site last Friday afternoon----I wonder why? Supose he was wondering whats going to hit him at the Seminars--Hope its an accurately flung chicken leg?
What a strange out-of-touch management tool he is? What exactly is his title/purpose?
I could make a decision as to whether I liked him or not if he showed himself?
What is he trying to hide or protect?
Sensible answers only, please, on the head of a pin to me..
