How about this, 2 weeks ago I went out to fit 10 rollers and 3 romans (£1365) for a customer. It's a new build. When fitting the first roller, the husband says 'Don't bother about the airvents on the window if they get in your way. Got to last roller 'Oh sh*t a mismeasure' I inform customer that I will reorder and return. It transpires that the lady of the house has rung Hillarys and complained that the blinds are too close to the airvents. Hillarys send out the other advisor in this Northern Rugby Leaque town to give a second opinion. This advisor tells Hillarys that he has remeasured ALL 10 rollers and he wants them DOR'd! and he wants the commission for the job and me fined £200 Does an advisor with 7 years experience with Hillarys do 10 Mismeasures on one job? Talk about screwing your fellow man !

In the old days of Albany Blinds I was in a conservatory measuring. I always sold Albany on the back of Hillarys. I mentioned this to the customer who told me that the Hillarys man was calling on her the next day. I said it would only be fair to call him and tell him that I was there. She phoned him and told me that he had told her ..........'Whatever he quotes you I will do it 10% less' I had walked out of houses where he had left a quote in the interests of fairness. I called him and told him if he tried that trick again again I would break his legs. This was 5 years ago, we have not spoken since. How greedy and petty can one human be to another?

Iam afraid that when we were trading as 3 sister companies, this sort of thing went on. I know it was annoying but the onlyway I found to come to terms with it was to assume they were seperate companies and treat them as such. If that meant under cutting their price then so be it. I had to put food on the tabel. They were doing it to me and as I was the Hillarys agent it got to me that they would say they were part of the Hillarys group and there was no point getting me out as well. I did not do this at first but soon became more like them and did the same. Are you saying that it is the same guy that tried to undercut you that wants you fined 200 quid. Is it really the agent who has said this?. I can not believe that one agent would do this to another, it just breeds resentment. No decent agent of 7 years is likely to make 7 miss measures. Its things like this that put sales people in bad moods and not able to sell as well as they should. It sounds like you have a patch war going on. This is what your FSM is there for, have a word. There is never a winner in these situations. Its either forget it and get on with it or fight fire with fire. Red

Alan, have you complained to TV about this. He is on a mission to cut DORS like this & should bollock the other agent for this as to quote his words to me " Always speak to the original advisor first & get the full story". A job I am going back to for another new agent is being done as goodwill. Strike while the iron is hot!

So If I was an Albany Agent years ago with an Albany Contract ( I had signed) and then they folded that and made me a Hillarys Agent---BUT THEY NEVER GOT ME TO SIGN A NEW CONTRACT WITH HILLARYS--(which they didn't)--how does that leave me when Hillarys now tell me" Its in your Contract--You have to do it this way--?? and I replied I havent got a Contract...... Where do I stand?

I'm no lawyer but I think if you continue working and know that there is a new contract then it can be argued you are covered under that. Interesting situation.
This is why I'm not happy just continuing to work with these new payment and charges terms without then being clarified, I think in law if you continue to work you are accepting them as part of your contract.

surely the way to get over this is to contact your fsm in writing /email stating that you do not consider this a change in contract and therefore do not acknowledge the changes unless they are in writing.this will then put it in their court ,also keeping a copy for yourselves

I might not agree with it, and I certainly do not want to continue with the present situation where nothing is confirmed in writing, and FSM's just blather on and on and end up being right, and "Its only you" mania starts again? --and while I'm at it--" What ever happened to the stolen Commission? Where does it say inanyones contract that Hillarys can pay us whatever figure they decide and where does it say they can claw-back money 6 weeks after it has been paid, because of a percieved complaint--never investigated and never mentioned to me? / and as for Advisors Forum answers to Questions?? as for the arsehole who put ithe dor's in slash his f***ing tyres so the tw*t can't work, its all he deserves No no no much better to remove his tyre valve dust-caps and then place a tiny tiny pebble under each cap and screw it back down. It takes acouple of days for them all to go down..then they never all go down at once, and hopefully two will go down close to each other and he wont have a spare, and when he looks for the cause and removes the dust cap the tiny tiny pebble falls on the ground and the evidence is lost....
