Hereticus I take your point, but I know that if I "come out" I will get the bullet. Plain and simple. I was told by the FSM --after emailing RossK about my agreed genuine grievances re STOLEN COMMISSIONS--that I was to drop it, OR SUFFER THE CONSEQUENCES, earlier this year. I have this strange feeling that you have the "pro-Hillary" chip installed and good lucjk to you, but I have a wife on Night Shift as a Nurse and me doing 10 hours x 6 days on blinds and I cannot afford the bullet. Even as you suggest if I email Ross in the open, or ring him, I have been told " DO NOT GO THERE ON STOLEN COMMISSIONS" So Hereticus I have to remain in the dark, so to speak. It is very frustrating, seeing your money Stolen by these sons of unmarried parents, but Hillarys are doing the Ostrich by not wanting to even discuss it, and then putting in the hard word if I persist via the FSM. They are a Mafia, and why should I not slight, or hurt the feelings of , in your words a senior member of management, when, from my standpoint, they are born thieves, hyenas, and lying swine who do not follow through with promises made to you and youir fellows at the January meetings. I will not genuflect in his/their presence, or anybodys for that matter--I was in No.3 Parachute Regiment for 16 years. I will use this site to let all the rest who have had money stolen, what is happening... If Ross K decides to not reply/get involved/ or send idle threats via a p***k of an FSM, then that is not the end of it with me. I am trying to do it in a gentlemanly manner, protecting my job at the same time. the way you suggest will get me the bullet..... I will see this through, with or without your help. You can steal from me only so often.....then it stops... The offer is there for Ross K ( what is the rest of its name?) in his "senior management capacity" to address this once and for all. Not replying IS TAKING PART in my book. He now has time to respond. Lets see what he can do. No threats, no underhand dealings, just asking firmly--then if that doesn't attract attention we will have to see what it will take to discuss things civilly,or in a sensible-no threat- environment. Over to him, and over to you ,assuming you are his mate or his mouthpiece, which I am sorry to say is the pacifying manner you seem to condone his appalling THIEVING on a massive scale. Blindsfitter

OK, so I seem to be unwittingly setting myself up on this (again).
Firstly, I don’t know how to resolve this issue of clawbacks, whether it will ever be resolved, or whether it will continue to fuel resentment for months and years to come. I don’t know who is making policy in this matter, or who has the authority to review specific cases, and it does seem that the company have swept the problem under the carpet.. However, I do strongly believe that personal character assassination in open forum is not going to do anything to help the cause and actually just serves to alienate the very people you should be talking to, equally to alienate many of your colleagues and fellow advisors in the process, and to polarise the issue even further.
Secondly, Blindsfitter, I resent the implication that I am a mouthpiece for Ross Kenney or for Hillarys, and that I condone their actions with regard to clawbacks, and that I am fitted with a ‘pro-Hillary’ chip. That is nothing but a cheap shot, and way off target, and you know it ! The fact that I object to the manner in which you choose to pursue your case does not mean that I deny the fact that you have a case, and I don’t understand what weird leap of imagination equates the two in your mind.
Is Ross Kenney my ‘mate’ as you suggest ? Depends on your definition of ‘mate’. I have had many disagreements and quite heated discussions with Ross Kenney, some just between the two of us, and some observed by other advisors, management, and FSM’s at various forums and meetings. I have also enjoyed a few pints with Ross, have enjoyed his company socially (at work related gatherings), and feel that I have open access to him as he will usually accept my calls. The point is that we can disagree without falling out, that we treat each other with mutual respect, and that we can discuss any subject in a constructive and civil manner. If that fits your definition of ‘mate’ then so be it - personally I think it simply means that he is someone I can do business with, that we can agree to disagree without taking it personally - but I am not his mouthpiece and I am always ready to challenge him and the rest of management if I feel that I have a valid point to make.
You and I are from very different backgrounds and have very different approaches towards resolving conflict. Your military background favours the direct approach, though you seem to favour sniping from behind cover rather than open combat. My background favours negotiation and diplomacy, which involves getting to know the opponent, gain their confidence, and seek areas of common ground in order to facilitate constructive discourse in the areas of disagreement. My approach would be absolutely useless in a war zone front line and I would be eternally grateful to have you and your experience by my side, but perhaps your approach may be too direct, too blunt, even too scary for your current mission.
I would love to see the issue of clawbacks settled once and for all, preferably in favour of you and all the advisors who have suffered the consequences, but I don’t think that hurling personal abuse and slander is going to motivate anybody to want to listen to your case or invite you round the negotiating table.

OK ladies, enough is enough. Your battle is not with each other but Hillary's. Stolen commission is a big issue with quite a few advisor's.(doesn't effect me, never had it done). Not to say I condone it though.
It wont go away until it is resolved, whether that is amicably by the company or legally only time will tell so in the meantime I suggest you both offer up the white flag and leave the battle between differences of opinion. We all have opinions, thats what makes us different.

Hereticus and Blindsfitter.... It seems ALL approaches have been tried on this issue. Both Blindsfitter and I have contacted Ross Kenney and been totally ignored by him.... other than receiving a call from our FSM's suggesting it might be a good idea not to ask again, if we value our jobs. Anyone else tried and failed?? Or also warned not to mention the subject again! I agree that a diplomatic approach is more likely to get a response. Which is my way of diplomatically asking Hereticus if he will email/write to Ross Kenney on our behalf. It would be nice to have a written answer regarding Hillarys stand on this. We know it is illegal. What are Hillays going to do about it? That's the very first and basic question that needs an answer. Hereticus? Do you feel you can do this?

All good points well put RED, we had all this a while back.
People will deal with things in different ways. So let's be tolerent of eachother and respect the opinions even if you don't agree with them.
I will say this only once.
The forum as you all know it will be shut down if this kind of thing persists.
Or at very least, members will be suspended ( not banned tho ) .

Weren't we told this would NEVER happen again?? Mine also came this morning Joy,so you are not on your own. The thing is though, is it really forced availability. I usually do 3 sales in a slot and they are pushing it to 4. If I dont want to do 4 I just ring in and remove it. There is nothing they can do if I dont want to do 4. Trouble I have is I already do 4 even though it should be 3 (confused yet?) so they force it up to 5. Cant win. But I can reduce it if I want. Its just so much messing around with your diary that annoys me.

Does anyone know WHY the commission clawbacks were stopped?
If it was out of the goodness of their hearts, we can only appeal to their good nature, which obviously isn't getting anywhere.
On the other hand if, as many suspect, it was found to be illegal, then Hillarys don't have a leg to stand on. Ignorance of the law, as we all know, is no excuse. Taking money in the belief it was legal is one thing. Keeping that money, knowing it was taken illegally is something very different - it's a criminal act.
Mike, do you feel able to ask Ross Kenney, and do you believe you will get an honest answer, as to why it was stopped?

Weren't we told this would NEVER happen again?? I got mine today, but that's telling me it's being done in Sept. Wasn't the original email about August? Personally, I'm finding all these leads tiring. Today, Saturday, I had 5 leads for 8 hours availability. And tomorrow, with 7 hours available on Sunday I've got ......... 1 WHOLE LEAD ---- YIPPEE ;D ;D

So Ross K condones stealing the money from us in Clawbacks, does he??? Who does this guy think he is....Its not up to him, a jumped up rep, to decide whether we should have our earnings stolen by accountants. How dare he the little pip-squeak. ? I have sent him a pm telling hiom as much...!!!!!!!! Why doesnt he put something in the newsletter stating what the current thinking is at Head Office is regarding Stealing Commissions.. I am sorely hacked off with this guy. I have never met him.. never spoken to him... Wouldn't know him if he knocked on my door... Yet he has the gall to thieve our money..... Its high time he had a talking to!!!! Hereticus seems to lay some store by the guy WHY ? Hes a Fagin, ( Head of Pickpockets) is Ross K... If any of us took money off clients and didn't return it in full to Hillarys we would be sacked..... THEN WHY IS HE STILL HERE? ?? I suggest a mass email campaign to John-boy R, telling him he has a Head of Theft on the Staff might open his eyes. That guy is only told what folk want him to hear anyway!! I had £42.00 taken off me in 2 deductions on jobs where customers were given discounts because they complained , and I was never involved.!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! Why should I not want his head on a plate? ?? SOMEONE TELL ME THAT? ?? The little --- Blindsfitter Blindsfitter.....when I read a posting like this I can fully understand why Hillarys have not embraced this forum, why we do not get company responses to any of our issues, and also why so many advisors log on to the forum for a look but don't actually take part. I accept that you have an issue, that your feelings about the clawback issue from last Christmas are valid and still unresolved, and that you are not alone in feeling that you have been shafted by the company, and I would support you fully in any reasonable efforts to clarify the matter and finally put it to bed. I do not, however, condone the use of this forum for directing an abusive and slanderous rant at a senior member of management from behind your protective veil of anonymity. How can Ross Kenney or anybody else defend himself against your attack, or even comment on your issues, when he has absolutely no idea who you are ? You mention that you have sent him a personal message through this forum, but that still maintains your anonymity so don't hold your breath waiting for a response. I accept that you have a genuine issue so come out from behind your shield and take it up properly. By all means retain your anonymity on this forum but that doesn't stop you calling Ross Kenney direct, or sending him an email in your proper advisor capacity, or even requesting a meeting with him at Nottingham or asking him to come and see you. So please stop using this forum as a medium for spitting venom and take some personal responsibility for discussing and resolving your issues with the company in a direct and mature way. ive said all along, why does anyone need to hide behind their alias. quite right, come on out, then perhaps Ross will respond. He came straight away to see me personally to my home when i "came out". Nothing changed though. Oh i forgot. he overuled my f.s.m and sorted my diary postcodes, and up to now it is working well. Shame about all the other issues. withyside 214 737 Huddersfield

Can I remind you that a memo was sent out to us all on or around 22/03/06 regarding issues we had raised including 'claw backs'!!!
This 'admission/acknowledgment' of the problem of 'claw backs' given to us in writing may well be the leverage we need to take Hillarys to Court to get our money back.
Perhaps 'sweeping this under the carpet' my not be enough for Sillarys after all???!!!
If anyone wants to run with this, then please feel free to do so!
Regards!
Remaining anonymous out of choice & necessity ... greenpesto!!!
p.s.
Forced availability should never haver been an issue during the summer!!!
Why?
Because it is stupidity to throw thousands of ££££'s at advertising during a holiday period when customers are away on holiday or that the Sales force would be doing the same & are therefore not around to service those calls!!!
You also don't try to increase your sales if you can't support it with stock to meet demand & to find that your suppliers are also away on holiday!!! ( Have you seen the OOS list? ).
Total madness!!!!

Bit of positive news today. May help others. After receiving on Saturday the memo about increasing availability for September i thought enough was enough. So i sent an email to both FSM and DM stating i had no such wish to have my diary increased especially when already you are adding appts as 3x15mins. Well today B.HOL MONDAY i had a nice email back from a JOANNE in DM to say she will speak to my FSM and make sure my diary is kept to normal. THANKYOU JOANNE If only everything else could be sorted so easily.

Hope you had chance to read my exchanges on this with various folk over weekend. I have been given cracking advice on how to get even by those who contacted me, and if you want a "pm" then just ask me how. ,,and NO! it does not involve getting your teeth into anything of mine!!
